These Terms of Service ("Terms") govern your use of the BusyMind AI mobile application and website (collectively, the "Service") operated by BusyMind AI ("we," "our," or "us"). By using the Service, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using BusyMind AI, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

BusyMind AI is a note-taking, task management, scheduling, and AI-powered productivity application available on iOS and the web. Features include smart notes, tasks, calendar, reminders, team collaboration, and AI-assisted content processing.

3. Accounts and Eligibility

You must be at least 13 years old to use the Service. You are responsible for maintaining the security of your device and any content you create. You agree to provide accurate information when using the Service.

4. Subscriptions and Payments

BusyMind AI offers free and paid subscription tiers (Basic, Individual, and Team). How you pay depends on how you access the Service:

• iOS (App Store): Paid subscriptions purchased in the iOS app are billed through Apple's App Store and are subject to Apple's terms and conditions. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Refunds are handled according to Apple's refund policies.
• Web (Stripe): Paid subscriptions purchased through our web application are processed by Stripe, our third-party payment processor. By subscribing on the web, you agree to Stripe's applicable terms and privacy practices. You authorize us and Stripe to charge your selected payment method on a recurring basis for your chosen plan until you cancel.

Web subscriptions renew automatically at the end of each billing period unless you cancel before renewal. You can manage or cancel your web subscription through your BusyMind AI account settings or by contacting us at support@busymindai.com. Price changes will be communicated in advance where required by law; continued use after a price change constitutes acceptance of the new price.

Refund requests for web purchases are handled on a case-by-case basis in accordance with applicable law and our refund policy. Stripe facilitates payment processing only; billing disputes for web subscriptions should be directed to us at support@busymindai.com.

5. Free Tier Limits

The free Basic plan includes limits on notes (10 per month) and folders (up to 3) as described in the app and on our website. Paid Individual and Team plans unlock unlimited notes, full AI features, and team collaboration respectively.

6. User Content

You retain ownership of content you create in BusyMind AI. By using AI features, you grant us a limited license to process your content solely to provide the requested features. You are responsible for ensuring your content does not violate any laws or third-party rights.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, decompile, or hack the Service
• Upload malicious code or content that infringes on others' rights
• Abuse AI features to generate harmful, illegal, or spam content
• Share account access in ways that violate your subscription tier

8. AI Features Disclaimer

AI-generated summaries, action items, and suggestions are provided for convenience and may contain errors. You should review AI output before relying on it for important decisions. We do not guarantee the accuracy of AI-generated content.

9. Intellectual Property

The BusyMind AI app, website, logo, design, and underlying technology are owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

10. Termination

We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service at any time by deleting the app. Upon termination, your right to use the Service ceases immediately.

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by law, BusyMind AI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

13. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be communicated through the app or website.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.
